Terms and Conditions of iSpot Service
Thank you for choosing the iSpot service (the "Service") of ForthMedia, Inc. ("Forthmedia"). These Terms and Conditions of iSpot Service (these "Terms") constitute the entire agreement between you and Forthmedia with respect to the Service. By having checked "I Agree" on the Forthmedia iSpot Service registration page, you have agreed to be bound by these Terms.
Service Generally
As set forth in these Terms, Forthmedia will work with you to create a single webpage to convey your business message (the "Page"), and will host and maintain the Page during the Service term you have selected at registration (12-months or 24-months). In order to create the Page, Forthmedia will first discuss your needs with you, and accept from you any materials or information that you wish to provide to be incorporated into the Page (collectively, the "Materials"). Your provision of Materials to Forthmedia will be deemed a license grant from you to Forthmedia to use the Materials as contemplated herein. Forthmedia usually requires one week to create the Page. Prior to the Page being made available on the Internet, you will have an opportunity to review its contents. If necessary, Forthmedia will make no more than one revision to the Page.
Update Capability
Forthmedia anticipates that during calendar year 2012, Forthmedia will provide you with the ability to use the Internet to update certain information displayed on the Page.
Page Not Transferable
You understand that the Page is created by Forthmedia using Forthmedia's proprietary software. Accordingly, the Page is not transferable, and neither the Page nor Forthmedia's proprietary software will be made available to any other service provider, operator, or other party, including you.
No Guarantee of Page Availability
You understand and agree that Forthmedia will not be responsible for any failures of the Page to be available due Internet service failures or interruptions, or failures of any service networks used by Forthmedia.
Use by Forthmedia
You agree that Forthmedia will have the right to use the Page, or any Materials, to promote services provided by Forthmedia by any means or media Forthmedia may choose.
Upgrades to Service
From time to time Forthmedia may offer you upgrades to the Service, for which Forthmedia may or may not charge additional fees. In all cases, you may accept or reject such upgrades in your sole discretion.
Credit Card Billing
We will automatically charge your credit card monthly, for the cost of iSpot Service. If we are unable to process your transaction using the credit card information provided, we reserve the right to terminate the Service.
Revisions to Terms
These Terms may be updated by Forthmedia at any time and from time to time, without prior notice.
